Court rules on AI in filings

All Indiana trial courts.

Ind. Trial Rule 11(B), as amended (Order 26S-MS-8).

In force when read In force since 1 August 2026; read on 5 November 2026.

  • Certify that it was checked

The court’s words

“(B) Certification. The signature of an attorney certifies that the … has read the pleadings, motion, or other submission; that to the best of the attorney’s … that any cited legal authority is authentic; and that it is not … delay or harass.”

Quoted from the court’s own document, read on 5 November 2026. Read it at the source.

Trial Rule 11.1(C), for a party not represented by an attorney: “(C) Certification. The signature certifies that the signer has read the pleading, motion, or other submission; … that any cited legal authority is authentic; and that it is not presented to delay or harass.” Source.

The order is a redline, so the attorney’s rule is quoted in its new words with the struck ones left out. New Trial Rule 11.2 lets a court find a filer who cites fictitious legal authority an abusive litigant and restrict their filings.

What it asks of the person who signs

  • Certify that it was checked

in the filing: that the content and the citations were verified.

Applies to: Every pleading, motion or other submission in an Indiana trial court. Where it goes: Made by signing: an attorney’s signature is the certificate (Rule 11(B)); a self-represented party’s signature certifies the same (Rule 11.1(C)). No separate statement.

The statement, if one is called for

Nothing to draft: under this rule, filing the paper is itself the statement.

On the check page Loupe drafts the statement for this court from the parts you tick, for you to read and sign: what it says is your choice and your responsibility. The order in force on the day is what counts; read it at the source before relying on this page.

Check the filing first

Paste the brief or drop the file, and Loupe looks up every citation in the published record: whether the case exists, whether it is the case the filing names, whether the pin cite falls inside the opinion; statutes, regulations, court rules and links too. It doesn’t generate anything, and what it can’t settle it marks “not verified”, never clean.
